DMCA / Copyright Policy

GovCertix LLC (“AutoSAM”) respects the intellectual property rights of others and expects its users to do the same. This policy explains how we respond to notices of alleged copyright infringement under the Digital Millennium Copyright Act (17 U.S.C. § 512) (“DMCA”).
1. Public data source disclaimer
AutoSAM aggregates, indexes, and monitors data sourced from publicly available United States government databases, primarily SAM.gov (the System for Award Management). This data is published by the U.S. federal government and is generally not subject to copyright protection under 17 U.S.C. § 105. However, if you believe any content on the AutoSAM platform infringes your copyright, you may submit a DMCA takedown notice as described below.

3. Filing a DMCA takedown notice
To submit a valid DMCA takedown notice pursuant to 17 U.S.C. § 512(c)(3), your notification must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit AutoSAM to locate the material (e.g., URL or screenshot).
- Information reasonably sufficient to permit AutoSAM to contact the complaining party, such as an address, telephone number, and email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-notice process
If you believe your content was removed or disabled in error, you may submit a written counter-notice to our designated agent at hello@autosam.io. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the Eastern District of Virginia, Alexandria Division), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter-notice, AutoSAM will forward it to the original complaining party and restore the removed material within 10–14 business days unless the copyright owner files a court action seeking a restraining order.
5. Repeat infringer policy
In accordance with the DMCA, AutoSAM maintains a policy to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. If a user is found to have repeatedly uploaded or shared infringing content, AutoSAM reserves the right to disable or terminate their account at its sole discretion.
6. Good faith & misrepresentation
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorneys’ fees.
